1. Acceptance of Terms
By accessing, downloading, installing, or using the Playder application ("Service"), you agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Playder.
2. Definitions
For the purposes of these Terms:
- "Service" or "Application": Refers to the Playder mobile and web application, including all features, content, and functionality.
- "User" or "You": Refers to any individual who accesses or uses the Service.
- "User Content": Refers to any content, including messages, images, and other materials, that you create, upload, or share through the Service.
- "Playder" or "We": Refers to the company providing the Service.
3. Eligibility and Age Requirements
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- You are not prohibited from using the Service under applicable law
4. License Grant and Restrictions
Subject to your compliance with these Terms, Playder grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer, decompile, or disassemble the Service
- Remove any copyright, trademark, or other proprietary notices
- Use the Service for any commercial purpose without our express written consent
- Use automated systems (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or servers connected to the Service
5. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Account Security: Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access
- Accurate Information: Provide accurate, current, and complete information during registration and keep it updated
- Account Responsibility: You are responsible for all activities that occur under your account
- Account Termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms
6. User-Generated Content
You retain ownership of any User Content you create, upload, or share through the Service. However, by submitting User Content, you grant Playder a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of operating and promoting the Service. You represent and warrant that:
- You own or have the necessary rights to the User Content
- The User Content does not infringe any third-party rights
- The User Content complies with all applicable laws and regulations
- You will not share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
7. Prohibited Content and Conduct
Playder has a zero-tolerance policy for objectionable content and abusive users. You agree not to use the Service to:
- Share illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, or obscene content
- Impersonate any person or entity or falsely state your affiliation
- Share personal information of third parties without their consent
- Infringe intellectual property rights, including copyrights, trademarks, or patents
- Transmit spam, unsolicited messages, or promotional content
- Engage in any activity that could harm, disable, or impair the Service
- Collect or store personal data about other users without their consent
- Use the Service to violate any applicable laws or regulations
8. Intellectual Property Rights
The Service, including its original content, features, and functionality, is owned by Playder and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. All trademarks, service marks, and trade names are the property of their respective owners. You may not use our intellectual property without our prior written consent.
9. Content Moderation and Removal
Playder enforces a zero-tolerance policy for objectionable User Content and abusive behavior. We may use automated tools to filter objectionable profile content (including nickname and bio) before or when it is saved; content that violates these Terms may be rejected automatically. Profile images may also be reviewed before they are published. Within the Service you can report inappropriate content or users, block abusive users, and contact support to report inappropriate activity (including by email at support@playderapp.com). When we receive a valid report, we will review it and take appropriate action within 24 hours, which may include removing the reported content and suspending or permanently terminating the offending account. We may also remove content and restrict accounts on our own initiative. We are not responsible for User Content posted by users and do not endorse any opinions expressed by users.
- Automated filtering: nickname, bio, and similar profile text may be screened automatically; prohibited content may be rejected
- Image review: profile photos and banners may require approval before publication
- Report: use in-app reporting tools to flag objectionable content or conduct
- Block: block users so you no longer interact with them in the Service
- Contact support: reach Playder in-app or at support@playderapp.com to report inappropriate activity
- Enforcement: content removal and account suspension or ban may occur immediately when Terms are violated
10. Limitation of Liability and Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Playder is not responsible for:
- Damages arising from the use or inability to use the Service
- Content shared by other users, including offensive, inaccurate, or illegal content
- Service interruptions, errors, or technical failures
- Loss of data or User Content
- Unauthorized access to your account or data
- Actions or omissions of third parties
11. Indemnification
You agree to indemnify, defend, and hold harmless Playder, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
12. Termination
You may terminate your account at any time by contacting us or using the account deletion feature. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, for any violation of these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete your account and User Content.
13. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the Service or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiations, the parties agree to seek resolution through appropriate legal channels in accordance with applicable law.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Playder regarding the use of the Service and supersede all prior agreements and understandings.
